Chapter 33 and the California College Fee Waiver

What is settled
  • Federal law directs VA to pay the actual net cost of tuition and fees after applying waivers and aid provided solely for tuition. A College Fee Waiver of systemwide tuition therefore reduces what Chapter 33 pays the school. Basis: 38 U.S.C. 3313.
  • The waiver does not stretch Chapter 33 entitlement. Months of entitlement are charged based on enrollment time, not on the dollar amount VA pays. Basis: 38 U.S.C. chapter 33 entitlement charge rules.
  • The monthly housing allowance and the book stipend are paid to the student and are not reduced by a tuition waiver. Basis: Chapter 33 payment structure.
  • The waiver covers systemwide tuition and fees only. Campus-based local fees can remain, and Chapter 33 can pay remaining mandatory fees when certified. Basis: CalVet College Fee Waiver program materials.

  • Campus sequencing: whether the campus posts the waiver before or after certifying charges to VA varies by campus and affects what gets certified.
  • Self-supporting and extension programs: waiver treatment varies by campus and is a standing Observatory audit question.

Chapter 35 and the California College Fee Waiver

What is settled
  • Chapter 35 pays the student a monthly benefit regardless of tuition charged, and the College Fee Waiver waives systemwide tuition at California public institutions; they address different costs. Basis: Program payment structures (VA Chapter 35 and CalVet CFW).
  • Whether the two may be received together depends on the waiver plan: CalVet prohibits concurrent receipt of Plan A benefits and Chapter 35, and Plan A recipients must sign an Election To Receive College Fee Waiver Benefits statement.   • Eligibility is determined separately: VA decides Chapter 35; CalVet or a County Veterans Service Office decides the fee waiver, plan by plan. Basis: Administering authority of each program.

  • Which plan applies: Plan A turns the choice into an election between the waiver and Chapter 35; Plan B allows both. The most used plan for children of service-connected disabled veterans (Plan B) includes an annual income limit CalVet publishes each academic year.

VR&E (Chapter 31) and need-based financial aid

What is settled
  • Federal law excludes veteran education benefits from the federal need analysis that sets Pell and other Title IV aid, so VR&E support does not reduce Pell eligibility. Basis: Higher Education Act need-analysis rules as applied by Federal Student Aid.
  • VR&E pays authorized tuition, fees, books, and supplies directly under the rehabilitation plan; the counselor's written authorization controls what VA pays. Basis: 38 U.S.C. chapter 31.

  • State and institutional aid packaging: whether a campus counts VR&E-paid charges as met costs when packaging state or institutional aid varies. VR&E (Chapter 31) and remaining GI Bill entitlement

What is settled
  • A combined cap limits total assistance across most VA education programs to 48 months; months used under one program count against the cap. Basis: 38 U.S.C. 3695.
  • VR&E participants who also qualify for the Post-9/11 GI Bill may elect a subsistence allowance at the higher Chapter 33-based rate while training under VR&E. Basis: VA VR&E program rules.
  • After Rudisill v. McDonough (U.S. Supreme Court, April 16, 2024), veterans with separate qualifying service periods may be entitled to benefits under more than one program up to the 48-month cap without a forced exhaustion order. Basis: Rudisill v. McDonough, 601 U.S. 294 (2024).

  • Individual entitlement accounting requires a VA determination; how VR&E months charge against a specific veteran's remaining Chapter 33 months is case-specific.

College Fee Waiver and Cal Grant

What is settled
  • A Cal Grant tuition award cannot pay tuition the fee waiver already removed; the campus aid office and CSAC rules resolve the packaging so the same charge is not covered twice. Basis: CSAC packaging rules; no duplicate payment of the same charge.
  • Cal Grant components directed at non-tuition costs address different expenses than the waiver and can still reach the student per current CSAC rules. Basis: CSAC program structure.

College Fee Waiver and the Middle Class Scholarship

  • The Middle Class Scholarship is calculated on remaining cost of attendance after other grants, scholarships, and an expected contribution. Tuition waived by the fee waiver is not a remaining cost, so the waiver typically reduces the MCS calculation. Basis: CSAC Middle Class Scholarship formula.

College Fee Waiver and the Pell Grant

What is settled
  • Pell is a need-based federal entitlement computed from the FAFSA's Student Aid Index; a state tuition waiver does not reduce the Pell award amount. Basis: Higher Education Act, Title IV Pell rules.
  • With tuition waived, Pell funds applied to the student account commonly exceed remaining charges and are refunded to the student for living costs. Basis: Title IV credit-balance refund rules.
  • Veteran education benefits are excluded from the federal need analysis, so GI Bill or Chapter 35 use does not reduce Pell. Basis: Federal Student Aid need-analysis rules.

Tuition Assistance and GI Bill benefits

What is settled
  • The same charge cannot be paid twice: TA-paid tuition cannot also be charged to a VA benefit. Basis: DoD and VA program rules against duplicate payment.
  • GI Bill Top-Up can pay the difference between TA and the full charge, using GI Bill entitlement for the portion covered. Basis: VA Top-Up program.
  • MGIB-SR pays the student monthly and can be received while TA pays tuition, because the two cover different things. Basis: Program payment structures.
What depends on the campus or case
  • Branch TA caps and eligibility change by policy year; the branch education portal controls approval before enrollment.

  • Confirm with the branch education office which charges TA will cover this term, and with the campus which remaining charges would be certified to VA if you use Top-Up.

Resident-rate rules and federal education benefits

What is settled
  • As a condition of GI Bill program approval, public institutions must charge covered individuals the resident rate; California codified conforming exemptions in Education Code section 68075.7. Basis: 38 U.S.C. 3679(c); Cal. Ed. Code 68075.7.
  • The resident-rate classification lowers the tuition base against which Chapter 33 payments and waivers are computed. Basis: Arithmetic of the net-payer rule on a smaller base.
What depends on the campus or case
  • The covered categories have been expanded by federal law more than once; whether a specific student is covered requires a written campus determination against the current federal definition.

Benefits in extension, self-supporting, graduate, and study-abroad programs

What is settled
  • CalVet states that self-supported academic programs, commonly referred to as extension courses or extended education, are not required to apply the College Fee Waiver, because those programs are neither state funded nor systemwide.   • Chapter 33 pays only for programs approved for GI Bill use and certified by the School Certifying Official; approval is program-specific, not campus-wide. Basis: GI Bill approval requirements (CSAAVE in California).
