Common questions

Questions veterans ask about this

How long do I have to appeal a VA decision?

All three AMA review lanes, Higher-Level Review, Supplemental Claim, and Board Appeal, allow one year from the date on the decision letter. Filing within that year also preserves the effective date that controls your back pay.

What happens if I miss the one year deadline?

You can still file a Supplemental Claim with new and relevant evidence, but the effective date will usually move to the new filing date instead of relating back to the original claim, which can cost back pay.

Does the deadline differ for a court appeal?

Yes. Appealing a Board of Veterans' Appeals denial to the Court of Appeals for Veterans Claims has its own window of 120 days from the Board decision, much shorter than the one year lanes.
