Sleep apnea evidence checklist.
Sleep apnea claims live and die on the sleep study and the connection theory. The 50 percent level generally requires prescribed CPAP use, so the prescription paper trail matters.
- A sleep study (polysomnogram or home study) with the diagnosis
- CPAP, BiPAP, or other device prescription and compliance records
- The connection theory: direct (symptoms in service) or secondary (weight gain from another condition, sinus obstruction, PTSD pathway)
- In service evidence: witnessed snoring or apnea episodes, fatigue complaints, buddy statements from roommates or battle buddies
- Daytime sleepiness examples: nodding off driving, at work, mid conversation
- Treatment for related conditions if claiming secondary (mental health, rhinitis, GERD)
- A spouse or partner statement describing snoring, gasping, or stopped breathing
- Weight history if the theory runs through weight gain
- Prior denial letter, if any, and the exact reason given
An educational list of evidence types VA commonly reviews for this claim family. It is not legal advice or a filing instruction, and a specific claim may need more, less, or different evidence. A VA accredited representative can review what your file actually needs.
