“VA can pull all of your private medical records without asking you.”
VA cannot obtain records from private doctors without your signed authorization. You control whether to authorize VA to request them, and you can always obtain and submit private records yourself.
What the regulation actually says
VA's duty to assist includes helping you get private treatment records, but only with your permission. Under 38 CFR 3.159(c)(1), VA makes reasonable efforts to obtain records not in federal custody, and the regulation requires the claimant to authorize the release: that is what VA Form 21-4142 does.
Records already in federal hands are different. VA can and does obtain your service treatment records, VA medical center records, and other federal records such as Social Security disability files without a separate release, under 38 CFR 3.159(c)(2) and (c)(3).
The practical takeaway: private records reach your claims file two ways, either you sign a 21-4142 naming the provider, or you request copies yourself and upload them. Many representatives prefer the second route because you see exactly what goes in.
The exceptions
- Federal records, including VA treatment and service records, do not require your authorization
- An authorization you sign stays valid until the claim ends or you revoke it, so scope it to the providers you intend
