Veterans with chronic fatigue syndrome often assume the weeks they could not leave bed speak for themselves. Under DC 6354 they do not: incapacitation counts only when a licensed physician prescribed bed rest and treatment, and the alternative pathway measures how far routine daily activities fell from the pre-illness level. For Gulf War veterans, CFS is presumptive under 38 CFR 3.317, no nexus opinion required.
Many veterans with chronic fatigue syndrome assume the weeks they spent bedridden speak for themselves. Under DC 6354 they do not. Incapacitation counts only when a licensed physician prescribed bed rest and treatment. The alternative pathway measures how far routine daily activities fell from your pre-illness level. For Gulf War veterans, CFS is presumptive under 38 CFR 3.317, so no nexus opinion is required.
How VA rates chronic fatigue syndrome
Chronic fatigue syndrome (CFS) is rated under diagnostic code 6354 (38 CFR 4.88b). The criteria measure debilitating fatigue, cognitive impairments such as inability to concentrate, forgetfulness, or confusion, or a combination of other signs and symptoms. Two alternative pathways apply at each level: how much your symptoms restrict your routine daily activities compared to your pre-illness level, or how many weeks of incapacitation they cause per year.
The percentage levels
- 10 percent: symptoms that wax and wane, causing periods of incapacitation of at least one but less than two weeks total per year, or symptoms controlled by continuous medication.
- 20 percent: symptoms that are nearly constant and restrict routine daily activities by less than 25 percent of the pre-illness level, or that wax and wane with incapacitation of at least two but less than four weeks per year.
- 40 percent: nearly constant symptoms restricting routine daily activities to 50 to 75 percent of the pre-illness level, or incapacitation of at least four but less than six weeks per year.
- 60 percent: nearly constant symptoms restricting routine daily activities to less than 50 percent of the pre-illness level, or incapacitation of at least six weeks total per year.
- 100 percent: symptoms nearly constant and so severe that routine daily activities are restricted almost completely, occasionally precluding self-care.
"Incapacitation" has a strict definition
A note to DC 6354 defines incapacitation as existing only when a licensed physician prescribes bed rest and treatment. Being unable to get off the couch on its own does not count. The prescription does. If you are riding the episodic pathway, ask your provider to document bed rest instructions in the medical record every time a crash forces one, because those weeks are literally the rating criteria.
The percentage-of-pre-illness pathway
This pathway compares your current activity level to life before the illness. That makes it inherently testimonial. A concrete before-and-after inventory, covering hours worked, chores handled, hobbies kept or abandoned, and social commitments dropped, gives the examiner something to measure. Statements from a spouse or longtime friend who knew both versions of you carry real weight here.
Gulf War veterans: CFS is presumptive
For veterans who served in the Southwest Asia theater, chronic fatigue syndrome is one of the medically unexplained chronic multisymptom illnesses that qualify for presumptive service connection under 38 CFR 3.317. No nexus opinion linking CFS to a specific event is required. Qualifying service plus a current diagnosis manifesting to a compensable degree does the work.
Common rating details veterans overlook
- Get bed rest prescribed, not just recommended. The incapacitation pathway counts only physician-prescribed bed rest and treatment.
- CFS and fibromyalgia are separate diagnostic codes. Both can be service connected, but overlapping symptoms cannot be paid twice under 38 CFR 4.14, so distinct manifestations must be documented.
- The 10 percent level includes symptoms controlled by continuous medication, the same trap as the mental health formula: controlled is not cured.
- Track crashes in a log. Dates, duration, and what each crash prevented turn "waxing and waning" into countable weeks.
