Rescission of Outdated Veterans Choice Program Regulations

Final rule, effective Aug 27, 2026.

The Department of Veterans Affairs (VA) is rescinding obsolete regulations that were previously implemented for the Veterans Choice Program, which has been replaced by the Veterans Community Care Program as of June 6, 2019.

VHA Used Wrong Deadline to Deny Emergency Care Claims, Leaving $373 Million Unpaid

VA OIG oversight report.

The VA OIG issued a management advisory memo on July 17, 2026, finding that VHA applied a 90-day filing deadline to third-party emergency care claims even though a 2022 federal law extended that deadline to 180 days. The OIG concluded that VHA's claim denials under the shorter deadline appeared inconsistent with the Cleland-Dole Act of 2022.

Wolfe v. Wilkie strikes down VA's reimbursement rule

The Court of Appeals for Veterans Claims held that VA's regulation barring reimbursement of deductibles and coinsurance for non VA emergency care was unlawful and certified a class of affected veterans.

Community care access standards take effect

Veterans became eligible for community care based on drive time (30 minutes average for primary and mental health care, 60 minutes for specialty care) and appointment wait time (20 days for primary care, 28 days for specialty care).
