Painful healed fracture

Situation. A healed stress fracture leaves painful residuals, or malunion with slight knee or ankle disability.

How the criteria apply. Malunion with slight knee or ankle disability, or painful residuals of a healed fracture, rates 10 percent under DC 5262.

Malunion with moderate joint disability

Situation. There is malunion with moderate knee or ankle disability.

How the criteria apply. Malunion with moderate knee or ankle disability rates 20 percent under DC 5262.

How the measurement should be taken. When this condition is rated on limitation of motion, the examiner is required to measure the joint with a goniometer, the instrument made to read the angle of a joint, and should not estimate the angle by sight. Under 38 CFR 4.46, the goniometer is described as indispensable for measuring limitation of motion in examinations within the Department of Veterans Affairs. If the exam report does not list goniometer readings in degrees, that can be a reason to question whether the exam was adequate. Read 38 CFR 4.46

A stress fracture that healed clean with no symptoms rates 0, but many leave a painful spot, altered gait, or early arthritis, and those residuals are what the codes pay for.

What VA looks at

The original fracture site and healing on imaging, residual pain and range of motion in the nearest joint, gait changes, and arthritis development.

Common exam and DBQ topics

Pain with impact activity, joint motion above and below the fracture, gait, brace use.

Evidence that usually matters

Service treatment records and profiles from the original injury, bone scans or MRI, current imaging, range of motion findings.

Common misunderstandings

Recruits absorb most stress fractures in basic training, and the service record of a profile or light duty is often the only proof; get it before claiming. Painful motion at the site supports 10 percent even when X-rays look healed.

If a VA decision on this came back wrong

Under the Appeals Modernization Act (38 CFR 3.2500), a Higher Level Review or a Board Appeal must be requested within one year of the decision notice. A Supplemental Claim can generally be filed at any time after the decision, but filing any of the three within that one year window is what keeps the claim continuously pursued and protects the original effective date; wait longer and a later award may start from the new filing date instead.
