Situation. Asbestosis shows FVC at about 78 percent of predicted, or DLCO around 70 percent.

How the criteria apply. FVC of 75 to 80 percent predicted, or DLCO of 66 to 80 percent predicted, rates 10 percent under DC 6833.

Situation. PFTs show FVC at about 70 percent of predicted, or DLCO around 60 percent.

How the criteria apply. FVC of 65 to 74 percent predicted, or DLCO of 56 to 65 percent predicted, rates 30 percent under DC 6833.

How this is usually measured. Most lung conditions are rated from a pulmonary function test, also called a PFT or spirometry. The test records values such as FEV-1, FVC, the FEV-1 to FVC ratio, and DLCO. Under 38 CFR 4.96, the rating is generally read from the post bronchodilator results unless the report explains why those cannot be used. If a decision relied on a general description of your breathing rather than the actual test numbers, that is worth a closer look. Read 38 CFR 4.96

The rating runs on the restrictive breathing numbers. The service connection side runs on the exposure story: which ships, which compartments, which jobs. Asbestos disease takes decades to appear, so a diagnosis in your 60s from exposure in your 20s is the normal pattern, not a problem.

What VA looks at

FVC and DLCO percent predicted, imaging showing the characteristic fibrosis or pleural plaques, the military exposure history, and any civilian exposure VA must weigh against it.

Common misunderstandings

There is no asbestos presumption, but M21-1 directs specific development of military versus civilian exposure. Pleural plaques alone without breathing impairment rate 0 percent, yet they still establish service connection and protect a future claim if fibrosis progresses.

If a VA decision on this came back wrong

You have three review lanes, pick the one that fits the situation.

Under the Appeals Modernization Act (38 CFR 3.2500), a Higher Level Review or a Board Appeal must be requested within one year of the decision notice. A Supplemental Claim can generally be filed at any time after the decision, but filing any of the three within that one year window is what keeps the claim continuously pursued and protects the original effective date; wait longer and a later award may start from the new filing date instead.
