Minimum rating for aphakia

Situation. There is aphakia or a dislocated lens, in one or both eyes.

How the criteria apply. Aphakia or lens dislocation carries a minimum 30 percent rating under DC 6029.

Rated higher on vision

Situation. Corrected vision in the aphakic eye is reduced.

How the criteria apply. Higher ratings follow the visual-impairment tables, evaluating the aphakic eye one step worse than measured (DC 6029).

How this is usually measured. Vision ratings rest on measured results: corrected visual acuity read from a standard chart, and where the field of vision is at issue, a visual field test on a Goldmann perimeter or an equivalent automated device. Under 38 CFR 4.76 and 4.77, VA records these in a set way. A rating built on a rough description of vision, rather than measured acuity and a charted visual field, is worth a second look. A 30 percent floor, full stop, even when an implanted lens restores sharp acuity. Trauma is the common service cause: a blast or blunt injury that dislocated or destroyed the lens.

The lens status on examination, the cause, corrected acuity in each eye, and whether an intraocular lens was implanted.

Common misunderstandings

The 30 percent minimum applies even after a successful lens implant. Traumatic cataract surgery that left the eye aphakic or pseudophakic still anchors to this code's floor.

Under the Appeals Modernization Act (38 CFR 3.2500), a Higher Level Review or a Board Appeal must be requested within one year of the decision notice. A Supplemental Claim can generally be filed at any time after the decision, but filing any of the three within that one year window is what keeps the claim continuously pursued and protects the original effective date; wait longer and a later award may start from the new filing date instead.
